The most important thing for you to do (outside of making certain police come to the scene to draft a report) is to seek medical treatment. The pain that can follow a motor vehicle collision may not always be immediate; most people first experience symptoms days to weeks after an accident. The prevalent thought throughout our society is that you should experience pain from an accident immediately after a collision, but in actuality, medical evidence has proven time and again that this common theory is simply not true. This is why it’s important for you to not accept any offer from the insurance company in the days or weeks following your accident.
The insurance company will want to speak with you to get your side of what happened, and they will push to do a recorded statement (a statement we strongly advise you not to provide). If you speak with them on the day of the accident, then you will most likely state that you are not injured due to the adrenaline and shock your body is still experiencing. Both the adrenaline and shock mask your injuries and make it seem as though you are not hurt. Thus, if you make this statement of not being hurt to the insurance company, then they can and will use this against you in the future if injuries and pain become apparent, and a settlement is being pursued.
During the initial days and weeks following the collision, the insurance company may even make you an offer to cover future medical expenses for a certain time period, lost wages, etc. Though this offer sounds enticing, avoid accepting this quick offer. Remember that you still do not know the true extent of your injuries, and as such, you do not know how long your medical care may last or what they will deem related or necessary for coverage. For example, if the insurance company settlement offer agrees to cover your medical expenses related to the collision for three (3) months, but diagnostic imaging (MRI, X-Ray, CT Scan, etc.) later reveals more serious injuries than first believed, then you will be stuck fronting those medical bills after that three month period with no legal recourse.
Again, immediately after a collision, you do not know the extent of your pain and subsequent injuries, and it may take weeks and even months of medical care to fully discover the extent of your injuries. This is why it is very important you do not accept what the insurance company may offer you initially.
